1. Acceptance of Terms

By accessing or using Classikly (classikly.com) and our marketplace services, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the platform.

2. Marketplace Role & Nature of Service

Classikly operates an online technology platform connecting independent collectors and fleet owners ("Hosts") with verified individuals and organizations ("Renters"). Classikly does not own, inspect, maintain, or operate third-party listed vehicles, except for providing digital escrow coordination, verification frameworks, and standardized agreements.

3. Renter Eligibility & Driver Verification

Renters booking classic vehicles must satisfy the following minimum conditions:

Must hold a valid, unrestricted driver's license suitable for the jurisdiction of operation.
Must meet the minimum age requirement specified by the host for particular high-value or manual collector assets (typically 25 years of age).
Must possess an authenticated payment method in their legal name with sufficient credit to satisfy the pre-authorization hold.
Only approved, verified drivers are permitted to operate vehicles under Self-Drive reservations.

4. Escrow Holds, Payments & Deposit Releases

Classikly coordinates payment pre-authorizations and captures via Stripe:

Pre-Authorization Vault: Upon host booking approval, a temporary pre-authorization hold covering the rental amount, platform fee, and refundable security deposit is placed on the renter's card.
Settlement & Capture: Upon safe vehicle return and completed post-trip inspection, the rental and service fee are captured, and the security deposit hold is automatically released back to the renter.
Damage Claims: If vehicle damage, fuel deficit, or excess mileage is recorded during checkout, the verified deduction is captured from the escrow hold, and any remaining balance is released.

5. Vehicle Use, Quirks & Operating Restrictions

Classic vehicles require mechanical care. Renters agree to adhere strictly to host-specified operating parameters:

Adhere to specified fuel requirements (e.g., 98 RON premium petrol).
Review and respect documented mechanical quirks and operating instructions.
No track use, racing, off-road driving, or unapproved commercial sub-leasing.
For Chauffeured or Static Display tiers, renters may not operate the vehicle under self-drive conditions.

6. Handover Check-In & Check-Out Inspections

Both host and renter are required to execute standardized digital check-in and check-out condition logs, recording photographic evidence of vehicle panels, fuel levels, odometer counters, and timestamped digital signatures. Handover logs serve as conclusive evidence in resolving any escrow disputes.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Classikly is not liable for indirect, incidental, punitive, or consequential damages resulting from mechanical failure, personal conduct, property damage, or cancellation between hosts and renters.

8. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising from platform utilization shall be submitted to the exclusive jurisdiction of the competent courts in Dubai, UAE.
